Regarding Pre-Need Funeral Contracts
“Pre-Need Contract” means a contract to furnish funeral Merchandise or service in the future.
“Funeral Merchandise” means any personal property offered or sold by any person for use in connection with the final disposition of a dead human body.
No person may sell a pre-need contract without first having a valid Certificate of Authority issued by the Department of Insurance.
All of the funds paid to or collected by any person under a pre-need contract for services, and 70 percent of all funds paid to or collected by any person under a pre-need contract for services, and 70 percent of all funds paid to or collected by any person under a pre-need contract for funeral merchandise, shall, within 30 days after the end of the calendar month in which payment is received, be deposited in this state under the terms of a trust instrument entered into with a national or state bank or savings and loan association having trust powers or a trust company.

Any contract purchaser or his representative or legal guardian may cancel a pre-need contract by notifying the certificate holder of such cancellation in writing. The certificate holder shall notify the trustee of such cancellation; and the trustee shall, within 30 days after receipt of written notification, pay to the contract purchaser or to the estate of the contract beneficiary all of the funds paid on the pre-need contract which are attributable to the sale of service and all funds paid on the pre-need contract which are attributed to the sale of funeral merchandise, except such amounts as may be retained by the certificate holder as liquidated damages as authorized by statute.
